Environmental Regulation, Duty to Notify
Conducted internal investigation into whether the hazardous material used in cooling systems in the client’s manufacturing facility triggered a duty to report to federal regulators. McKay Chadwell worked with the client’s experts and third party vendors to conduct a pump-down of the facility’s coolant systems to determine the mass of coolant present in the facility. Rather than determine that the facility possessed reportable amounts of coolant, McKay Chadwell determined that the system had systematic leaks, which caused coolant to escape continually at low levels. The client was able to repair the system before it failed and before the leaks caused a reportable environmental discharge of coolant.
