Public Records Act

Public Records Act, Law Enforcement Records

Successful representation of an individual wrongly accused of a crime who sought all public records from law enforcement’s investigation and subsequent police misconduct investigations. McKay Chadwell prevailed in a motion for summary judgment assessing over $40,000.00 in fees and costs against the Seattle Police Department (SPD). After SPD appealed, McKay Chadwell prevailed at the Washington Supreme Court creating case law that clarifies the “ongoing criminal investigation” exemption to the Public Record Act in favor of greater public access to police records. See Sargent v. Seattle Police Department, 179 Wn.2d 376, 314 P.3d 1093 (2013).
