We Routinely Use the Public Records Act as an Effective Tool in Litigation
Transparency is essential to ensure that public agencies effectively serve the public, the people who created the agencies. McKay Chadwell has earned a reputation for successful litigation of actions under the Washington State Public Records Act (RCW 42.56). For instance, McKay Chadwell successfully litigated the Washington State Supreme Court case Sargent v. Seattle Police Dept., 179 Wn.2d 376 (2013). In that case, the Supreme Court explained that a specific exemption under the public records act that allows police departments to withhold investigative records ceases to apply once the department refers the case to a prosecutor. In another matter, McKay Chadwell settled a public records act lawsuit against the City of Lynnwood for $63,575.00 after Lynnwood allegedly improperly withheld records without responding to the plaintiff records requester in a timely manner.
